As a foreigner, you are allowed to purchase land / property in Turkey, provided it is registered with a Government Tapu (title deed) at the local Council Land Registry office in Kas.

Whilst it is a straight forward system of purchase, please be clear at an early stage there are many whom wish to appear to want to give you ‘free’ advice.  This is often misleading and designed to confuse, and as such, if you are serious about purchasing property in Kalkan, we recommend you use only professional property agents of which there are only a small number.  Kalkan Ideal prides itself on giving clear comprehensive ‘above board’ help and advice through the buying process.

We can introduce you to a solicitor or if you wish, and are also happy to act as your Power of Attorney, this action is made through giving your legal permission at the notary office in Kas and allows us then to act on your behalf any legal matters concerned with the purchase keeping your best interest foremost.

Once a property has been found and both parties (seller/ buyer) agree on a sale, the usual amount payable by the buyer to the seller for a ‘holding’ deposit on the property is 10%.  This is a non-refundable deposit to the buyer if they decide to withdraw from the sale.  If the seller decides to stop the sale, all monies transferred by the buyer to the seller at this point are fully refundable.  You may wish to place a clause that the seller also owes a similar amount to the purchaser if they withdraw.

The buyer is not required to have a solicitor or agent acting on his / her behalf, however, it is Kalkan Ideal’s policy to strongly advise their customers to at least take legal advice to protect your interest and understanding during the sale.  Most certainly a reputable agent would give independent advice and would be happy to act as Power of Attorney to conduct the sale whilst the purchaser is unavailable either within or out of Turkey at the time.

At the time of completion of the sale the buyer will be asked to pay in full, the balance due on the sale to the seller at which time all persons involved in the sale, the seller and the buyer or power of attorney would go in person to the Tapu office Kas, where the title deeds would be transferred into the new owners name, completing the sale. Please note, the purchaser does not have to be present at the time of the title deeds transfer provided a power of attorney has been appointed to act on his / her behalf.  It is perfectly legal for a power of attorney to accept the title deeds in the purchasers name and hold this safely.

We should advise you, that the government makes a search on the proposed property / land area which usually is dealt with within around 8 weeks once the application has been submitted.  The Government must be satisfied that the land / property being purchased by the foreigner does not sit on or near to National Forestry or Military land of any sort.  The documentation for this is submitted by the agent, lawyer or power of attorney on your behalf to the Military offices in Izmir, this is a simple application requiring a photo copy of the purchaser’s passport and details of the land / property being purchased.

 

 

Fees & Charges

Our fees are in line with competitor real estate agents of Turkey which is currently 3% of the overall purchase price of the land / property within the sale.  There is also, a further 3% of the council calculated valuation price of the property / land.  This value is usually less than the actual sale price, half is paid by the seller and half by the buyer.

There is a statutory Government imposed earthquake insurance that the purchaser is required to take out on their property known as DASK. The cost is calculated on the council calculated valuation price (mentioned above).  It is also advisable to have additional private building and contents cover, which Ideal property are happy to arrange for you.

Finally, the new owner is required to register their name and property address with the local council and utility companies i.e. council tax, water and electricity billing. You should expect a charge for these.

To obtain a land line telephone service and the purchase of a car the foreigner is required to have a residents permit. This can be obtained in Turkey or the UK, by applying to the Turkish Consulate.  This has a cost and Ideal property will be happy to supply full information on obtaining this.
